The Nyamira High Court has heard how a disagreement between two brothers at their parents’ home allegedly turned tragic, leading to the death of one of them following a physical confrontation.
During the hearing, the accused, Japheth Kamanda Mogambi, told the court that the incident, which occurred on November 23, 2023, at around 7pm, was not intentional.

“It was not planned at all,” Kamanda told Justice Thripsisa Cherere.
According to testimony presented before the court, the deceased, Abel Mogambi, arrived home that evening allegedly intoxicated before a quarrel broke out over maize stalks that had been set aside for feeding cows.
The court heard that the disagreement escalated after Mogambi confronted the accused over the maize stalks.
During the altercation, the deceased reportedly slipped, fell on stones and sustained injuries.
Witnesses told the court there were no visible blood stains at the scene at the time of the incident.
Another brother, Ezekiel Isaboke later rushed him to hospital after finding him lying down in pain.
However, the victim later succumbed to his injuries, prompting police investigations that led to the accused’s arrest.
While giving his defence, Kamanda maintained that he had no grudge against his brother.
“I had no problem with my brother at all,” he said.
The case has drawn attention within the local community, with concerns raised over alcohol-related conflicts within families.
The court also heard that the parents, who were present at the homestead when the incident occurred, were unable to attend proceedings due to their health condition.
The matter is scheduled to continue on July 15.
