The land, identified as Nairobi/Block/80/44, measures approximately 7.39 hectares and is situated along Lower Kabete Road.
The court ruled that the property belonged to Ashok Rupshi Shah and Hitebkumar Amritlal Raja.
The court found that Chelogoi forged a letter of allotment dated January 31, 1995, purporting it to be a genuine document issued by the Commissioner of Lands.
He was also found to have knowingly presented forged documents at the Directorate of Criminal Investigations headquarters along Kiambu Road, Kiambu County, on October 11, 2023.
The documents included a letter of allotment dated January 1995 and a certificate bearing a forged signature and stamp impression attributed to Paul Achieng Pesa.
The documents were allegedly presented as genuine records relating to the allocation of the property and searches issued by the land registrar under the State Department for Lands and Physical Planning.
The prosecution, led by Sonia Njoki, Hillary Isiaho and James Murage, called 19 witnesses and presented documentary and expert evidence in support of the five counts against Chelogoi.
Following the conviction, Chief Magistrate Dolphina Alego cancelled Chelogoi’s bond terms and ordered that he be remanded at Nairobi Remand pending mitigation and sentencing on November 2, 2026.
The court also ordered the cancellation of any parallel title or registration issued over the property, affirming Shah and Raja’s ownership of the land.
