Judiciary Calls for Probe Into Ahmednasir Over Attacks on Supreme Court Judges
By Nyakundi Bwo “Otwere”

The Judiciary has officially called for investigations into Senior Counsel Ahmednasir Abdullahi over his continued public attacks targeting judges of the Supreme Court.

On Tuesday, Judiciary spokesperson Paul Ndemo confirmed that a formal request had been submitted to the Director of Public Prosecutions (DPP) to initiate investigations into Abdullahi’s conduct.

The move comes in response to Abdullahi’s repeated claims—mainly on his X (formerly Twitter) account—alleging widespread corruption within the judiciary. In one of his recent posts, the senior lawyer alleged that a Supreme Court judge received a Ksh 4 million bribe to influence the outcome of a pending case.

Despite the looming investigation, Ahmednasir remains defiant, stating that he will neither retract nor stop his public criticisms of the judiciary.

According to Ndemo, the decision to involve the DPP stems from what he termed as “relentless but baseless claims” by Abdullahi, which have undermined the credibility and integrity of the Judiciary.

“While criticism is a vital part of democratic accountability, it must be grounded in truth and pursued through appropriate legal channels,” Ndemo said in the statement.

He further emphasized that unsubstantiated allegations of corruption not only erode public trust but also place judicial officers at personal risk.

“The Judiciary has taken the extraordinary step of referring this matter to the DPP due to the gravity and consistency of Mr. Abdullahi’s allegations, which undermine public confidence in the administration of justice.”

Ndemo also called on the leadership of the Law Society of Kenya (LSK) and the Senior Counsel Bar to take disciplinary action where appropriate.

“We urge the LSK and the Senior Counsel Bar to exercise their mandates in bringing discipline and order among members—particularly SC Ahmednasir—and to help restore the dignity of the Bar and the legal profession.”

The developments come amid increasing scrutiny of the judiciary over its handling of corruption allegations. Earlier in 2024, Chief Justice Martha Koome told the BBC that in her 22 years as a judge and head of the judiciary, “nobody has ever approached me with a bribe.”

Her remarks followed criticism that the Judiciary had not done enough to investigate or address corruption within its ranks.

In response, CJ Koome has announced a change of strategy in the Judiciary’s anti-corruption efforts. While addressing the Magistrates and Kadhis Annual Colloquium virtually from Naivasha, she revealed that the Judiciary has now partnered with the Ethics and Anti-Corruption Commission (EACC) and the National Intelligence Service (NIS) to adopt an intelligence-led model.

“The new approach will help us identify patterns, hotspots, and individuals involved in corrupt practices—and to intervene early,” said Koome.

She reminded judicial officers of their responsibility to uphold integrity and restore public trust in the justice system.

“We are not just judicial officers; we are leaders in our communities, custodians of constitutional values, and agents of transformation. Let us lead with humility, serve with integrity, and carry out our mandate with diligence.”

“Let us recommit to ensuring that every Kenyan who walks into our courts leaves with their dignity affirmed, their rights protected, and their confidence in justice strengthened,” she added.
